A homeowner has blocked of a section of a horse trail in Yorba Linda. This section is only a feeder trail to a main trail but it has angered lots of residents. A protest was even held by horse owners. See video below from Fox.
Some of you might say that this makes for an UN-gracious neighbor in the Land of Gracious Living. From the little bit of research I have done it looks like not everyone has their facts straight.
There was a comment left today on the OC Register’s article about the subject.
It is a shame no one researched this a little better. There was never an easement in the recorded deed. The easement was in the CC&R’S for the houses on the street and then it only granted as an private equestrian easement for the homes on the homeowners side of the street. It was never a pedestrian easement, the homeowners pay property taxes on it and it is part of their lot. The homeowner’s went door to door to everyone included in the CC&R’S explained that they wanted to amend the CC&R’S to do away with the EQUESTRIAN EASEMENT they were able to obtain the majority of homeowners needed to change the CC&R’S. It was amended, and duly recorded with the County recorder. Taking this to the media with half truths is unfair. Because the people complaining the loudest would be the first one to sue if anyone in their families got hurt on that little piece of land.

I did go to the area in question and from my vantage point and looking at the maps this closure of a small feeder trail impacts only a few residents. I understand the residents anger but maybe there is a better way to resolve this problem instead of blowing things out of proportion and holding a protest.
If we get any more information I will post it here. But it seems to be that this issue may be closed and there is nothing more. Move along people nothing to see here.

PS. I was shocked this made it to network news. I’m suprised Yorba Linda gets any coverage. But then again the only remember the city name right now because we only had an earthquake that rocked So Cal a few weeks ago.

I have been following this story since the controversy started months ago….and it has surprised me that the owners of the home feel there is more inherient value in closing OFF the horse-way than keeping it open. It is the many trails that weave in and out of homes in YL that add charm and ahem,…..PROPERTY VALUE. I understand they got it recorded. I understand it is thier to block off. But still……it just seems so counter productive. In the end they are actually hurting themselves……………..Come on YL lets be nice! Great to see this covered on your site as well……….
This issue is more complicated than it first looks.
The unique issue at play is the 30 years of public usage by Yorba Linda residents. The California courts have favored the trail users over the private property owners in other similar cases.
I guess the courts may need to decide this one.
